Welcome to Loam Kiln. Throughout this document, "we," "us," and "our" refer to Loam Kiln. Loam Kiln runs on the Shopify platform, which powers our ability to deliver these Services to you.

By accepting these Terms, you confirm you've reached the age of majority in your home state or province, and that you consent to any minors under your care using the Services on devices you control.

Using our Services — whether browsing our store or making a purchase — may require you to share details like your email, billing info, payment info, and shipping address. You confirm that whatever information you give us is accurate, current, and complete, and that you're authorized to share it.

Keeping your account credentials secure is your responsibility, as is any activity that happens under your account. Accounts can't be sold, transferred, or licensed to anyone else.

SECTION 2 — OUR PRODUCTS

We work hard to represent our products accurately across our store. That said, colors and appearance can look different depending on your screen, device, and settings — we can't guarantee an exact match to what you see online.

Product descriptions may change at any time at our discretion, and we reserve the right to discontinue items or limit quantities available to any customer, region, or market.

SECTION 3 — PLACING ORDERS

Placing an order is essentially making an offer to buy. We reserve the right to accept or decline any order for any reason. An order isn't finalized until we confirm it, and payment must clear before that happens. Please double-check your order before submitting — once accepted, we may not be able to cancel it.

If we need to cancel, modify, or decline your order, we'll try to reach you via the email, billing address, or phone number you provided.

Any returns or exchanges follow our separate Refund Policy. By purchasing from us, you confirm the items are for personal or household use — not for resale or export.

SECTION 4 — PRICING & PAYMENT

Prices, discounts, and promotions can change without warning. Whatever price is listed at checkout is what applies, as confirmed in your order email. Listed prices don't include tax, shipping, handling, or import fees unless stated otherwise.

Prices here may differ from what's offered elsewhere, including other online or physical retailers. Occasional promotions may come with their own separate terms, which take priority over these Terms if there's a conflict.

You agree to keep your payment and account details accurate and current — including email, card number, and expiration date — so we can process orders and reach you when needed.

By making a purchase, you confirm: your payment information is accurate and complete, you're authorized to use the payment method, your issuer will honor the charge, and you agree to pay the full posted price including shipping, handling, and applicable taxes.

SECTION 5 — SHIPPING & DELIVERY

We aren't responsible for shipping delays. Delivery estimates are just that — estimates, not guarantees. We can't control carrier delays, customs holdups, or other outside factors. Once your order leaves our hands and goes to the carrier, responsibility for it (including risk of loss) transfers to you.

SECTION 6 — INTELLECTUAL PROPERTY

Everything on our Services — trademarks, branding, text, images, graphics, reviews, video, audio, and how it's all arranged — belongs to Loam Kiln, our affiliates, or licensors, and is protected under applicable intellectual property law.

You may not copy, distribute, alter, create derivative works from, publicly display or perform, republish, download, store, or transmit any of our content without written permission. Nothing here grants you rights to our (or Shopify's, or any third party's) trademarks, patents, or copyrights beyond what's explicitly stated. Unauthorized use may violate applicable law, and we reserve all rights not expressly granted.

Our name, logo, and related branding are trademarks of Loam Kiln or its affiliates and can't be used without our written consent. The same protection applies to Shopify's branding and any other third-party marks that appear on our Services.

SECTION 7 — THIRD-PARTY TOOLS

We may give you access to tools built by outside providers as part of our Services. We don't control, monitor, or vouch for these tools.

These tools are provided "as-is" and "as available," without any warranty or endorsement from us. We carry no liability for your use of them. Using third-party tools is entirely at your own risk, and you're responsible for reviewing and understanding that provider's own terms.

We may introduce new features or tools over time — when we do, they become part of these Services and fall under these same Terms.

SECTION 8 — LINKS TO OTHER SITES

Our Services may link out to third-party websites or include embedded third-party content. We don't review or vouch for anything on those sites, and visiting them is at your own risk.

We're not liable for any harm resulting from your use of third-party sites, products, or services. Review their policies carefully before making any transactions, and direct any complaints about third-party offerings to that third party directly.

SECTION 9 — OUR RELATIONSHIP WITH SHOPIFY

Loam Kiln runs on Shopify's platform, which enables us to offer our Services. However, any purchase you make is a transaction directly with Loam Kiln — not Shopify. Shopify holds no responsibility for any aspect of that sale, including damages or losses tied to the products or services purchased. By using our Services, you release Shopify and its affiliates from any claims connected to your dealings with us.

SECTION 10 — PRIVACY

Your personal information is handled according to our Privacy Policy, and in some cases, Shopify's own Privacy Policy as well. Using our Services means you've reviewed both.

Because Shopify hosts our Services, they collect and process data about your usage in order to help deliver and improve the Services. SECTION 11 — YOUR FEEDBACK

Any ideas, suggestions, reviews, or other input you share with us (collectively, "Feedback") comes with a license from you to us — perpetual, global, royalty-free, and sublicensable — to use, adapt, publish, and distribute that Feedback however we see fit, including commercially.

You agree your Feedback won't violate anyone's rights, won't be defamatory or obscene, won't carry malware, and won't misrepresent who you are. You're solely responsible for what you submit — we assume no liability for content posted by you or others.

SECTION 12 — ERRORS & CORRECTIONS

Occasionally, our site might have typos, inaccuracies, or missing information related to pricing, descriptions, promotions, shipping costs, or availability. We reserve the right to correct these at any time, and to update, change, or cancel orders affected by inaccurate information — even after you've already placed the order.

SECTION 13 — ACCEPTABLE USE

You agree to use our Services only for lawful purposes. Prohibited uses include: unlawful or malicious activity; violating any applicable law or regulation; infringing on intellectual property rights; harassing or harming others; spreading false information; sending spam or unsolicited promotional material; impersonating someone else; or engaging in conduct that disrupts other users or exposes us to liability.

SECTION 16 — LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT ALLOWED BY LAW, LOAM KILN, ITS PARTNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS (INCLUDING SHOPIFY) ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS — ARISING FROM YOUR USE OF OUR SERVICES OR PRODUCTS, REGARDLESS OF LEGAL THEORY, EVEN IF WE'VE BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES.

SECTION 17 — INDEMNIFICATION

You agree to defend and hold harmless Loam Kiln, Shopify, and our respective affiliates, officers, and employees from claims or damages (including legal fees) arising from your breach of these Terms, violation of law or third-party rights, or use of our Services.

We'll notify you of relevant claims, though delayed notice doesn't waive your obligations unless it materially harms you. We may control the defense at your expense but won't settle in a way that imposes non-monetary obligations on you without your consent.

SECTION 18 — SEVERABILITY

If any part of these Terms is found unenforceable, that part will be enforced to the maximum extent allowed, and the rest of the Terms remain fully valid.

SECTION 19 — NO WAIVER; FULL AGREEMENT

Our failure to enforce any part of these Terms doesn't waive our right to do so later. These Terms, along with any linked policies, make up the complete agreement between you and us, replacing any prior discussions or agreements. Ambiguities won't be interpreted against whichever party drafted the Terms.

You can't transfer your rights or obligations under these Terms without our written consent. We, however, may transfer or assign our rights without needing your consent or providing notice.

These Terms are governed by the laws of the jurisdiction where Loam Kiln is headquartered, and any disputes fall under the courts there.

We may update these Terms at any time by posting changes here. Check back periodically — material changes will be communicated as required by law. Continuing to use our Services after updates means you accept the new Terms.
